Actor Momentum terms and conditions
1. Definitions
“Programme” refers to The Actor Momentum Method.
“Coach” refers to Pangolily Ltd the service provider under this Programme.
“Client” refers to the individual booking the Programme.
“Session” refers to the Momentum Session and follow‑up check‑ins included in the Programme.
2. Booking Process
2.1 All bookings must be made via Calendly. https://calendly.com/anna_coaching/momentum_session
2.2 Once a booking is made, the Coach will send the Client:
- a secure payment link for the Programme fee; and
- an Intake form to be completed by the Client
2.3 The booking is provisional until both the invoice is paid and the Intake form is completed.
3. Completion of Booking Form
3.1 The Client must complete and submit the Intake form a minimum of seven (7) days before the scheduled Session.
3.2 Failure to submit the form by the deadline will result in automatic cancellation of the Session.
3.3 The Coach is not responsible for technical issues preventing form submission. It is the Client’s responsibility to ensure the form is submitted successfully.
3.4 The Coach will send a confirmation email once the form is received. If the Client does not receive confirmation within 24 hours, it is their responsibility to follow up.
4. Payment Terms
4.1 Payment should be made upon receipt of the payment link
4.2 If payment is not received by the time the form is submitted, the Session will be cancelled.
4.3 The Programme fee is £500 unless otherwise stated.
4.4 No work will commence until full payment has been received.
5. Cancellations & Refunds
5.1 The Client may cancel their booking at any time before submitting the Intake form and receive a full refund of any amount paid.
5.2 The Client has a statutory right to cancel this contract within 14 days of the date of booking without giving any reason (“the Cooling-Off Period”), in accordance with the Consumer Contracts Regulations 2013.
5.3 By submitting the Intake form and confirming payment, the Client expressly requests that the Coach begin delivering the Programme (including prep work, document review, and dashboard creation) before the end of the Cooling-Off Period, where applicable. The Client acknowledges that:
(a) if they cancel during the Cooling-Off Period before any work has begun, they will receive a full refund;
(b) if they cancel during the Cooling-Off Period after work has begun, they will receive a refund of the Programme fee less a reasonable amount for the work already carried out, calculated on a pro-rata basis;
(c) as Momentum Sessions are scheduled no earlier than 21 days from the date of booking, the Session itself will always fall outside the Cooling-Off Period;
(d) once the Cooling-Off Period has ended, the cancellation terms at clauses 5.4–5.8 below apply in full, and no refund will be issued in the circumstances they describe; and
(e) any documentation, materials, or outputs prepared by the Coach prior to the Momentum Session (including draft roadmaps or dashboards) remain the Coach’s property throughout the Programme and are provided to the Client only upon delivery during the Session itself, in accordance with clause 9.3. Where the Client cancels before the Session has taken place, no such materials will be provided to the Client, irrespective of any refund due under clause 5.3(b).
5.4 Once the Momentum Session has taken place, no refund will be issued, as the core service will have been fully performed.
5.5 Once the Cooling-Off Period has ended, if the Client cancels or fails to submit the Intake form by the required deadline, the Session will be cancelled and no refund will be issued.
5.6 If the Client chooses not to use the follow-up sessions, no partial refund will be provided.
5.7 Follow-up sessions may be rescheduled a maximum of two (2) times. After two reschedules, the session will be cancelled and cannot be rebooked, and no refund will be issued.
5.8 Refunds are not provided for dissatisfaction with outcomes, as the Programme focuses on clarity, structure, and momentum – not external industry results.
5.9 This clause does not affect the Client’s right to a refund or remedy where the Coach has failed to deliver the Programme as described, in accordance with the Consumer Rights Act 2015.
6. Programme Scope & Limitations
6.1 This Programme is a coaching-led career development service.
6.2 It is not performance coaching, acting training, or representation.
6.3 The Programme is not linked to Pangolily Talent Management’s talent agency services.
6.4 Participation in the Programme:
- is not a requirement for representation;
- does not influence decisions regarding new or ongoing representation;
- does not guarantee representation.
6.5 The Coach does not guarantee auditions, castings, meetings, or bookings.
6.6 The Programme focuses on the Client’s clarity, structure, strategy, and momentum, not external outcomes controlled by casting directors, agents, or production companies.
6.7 The Client acknowledges that coaching operations and talent agency operations are entirely separate business functions. Information disclosed during coaching sessions will not be used to evaluate the Client for agency representation. Furthermore, coaching does not restrict the Client from seeking, negotiating, or entering into representation contracts with other talent agencies.
7. Mental Health Disclaimer
7.1 The Programme is not therapy, counselling, psychological support, or mental‑health treatment.
7.2 The Coach does not diagnose, treat, or manage any mental‑health conditions.
7.3 The Programme is not suitable for individuals seeking therapeutic intervention or emotional crisis support.
7.4 Clients experiencing mental‑health challenges should seek support from a qualified mental‑health professional.
7.5 Any discussions relating to mindset, confidence, or emotional barriers are strictly within the context of career development and are not therapeutic in nature.
8. Client Responsibilities
8.1 The Client agrees to participate actively and honestly in all reflective exercises, questionnaires, and sessions.
8.2 The Client is responsible for ensuring all information provided is accurate and complete.
8.3 The Client agrees to attend sessions on time and in a suitable environment for coaching.
8.4 The Client understands that their progress depends on their own effort, consistency, and implementation of agreed actions.
9. Coach Responsibilities
9.1 The Coach will provide professional, supportive, and structured coaching throughout the Programme.
9.2 The Coach will maintain confidentiality except where disclosure is required by law.
9.3 The Coach will deliver the Programme as described, including:
- review of the Client’s questionnaire;
- coaching-led Momentum Session;
- strategic documentation;
- roadmap and dashboard creation;
- two follow-up check-ins.
10. Rescheduling & Missed Sessions
10.1 The Momentum Session may be rescheduled once, free of charge, provided the Client gives at least two (2) working days’ notice before the scheduled Session date.
10.2 Reschedule requests made with less than two (2) working days’ notice will not be accepted, and the Session will be treated as missed under clause 10.4, unless the Coach agrees otherwise at their sole discretion.
10.3 The rescheduled Session must take place within 30 days of the original Session date. If the Client does not rebook within this window, the Session will be treated as forfeited and no refund will be issued.
10.4 Missed Sessions without notice are forfeited.
10.5 Follow-up sessions may each be rescheduled up to two (2) times, provided the Client gives at least two (2) working days’ notice before the scheduled date.
10.6 Reschedule requests for a follow-up session made with less than two (2) working days’ notice will not be accepted, and the session will be treated as missed under clause 10.8, unless the Coach agrees otherwise at their sole discretion.
10.7 After two reschedules, a follow-up session will be cancelled and cannot be rebooked.
10.8 Missed follow-up sessions without notice are forfeited and cannot be rescheduled.
10.9 Late Arrival Policy: Sessions will start at the scheduled time. If the Client is late, the session will still end at the scheduled finish time. If the Client fails to join the session within fifteen (15) minutes of the start time, the session will be deemed a missed session, forfeited, and non-refundable.
10. Intellectual Property
10.1 All templates, frameworks, documents, and materials provided during the Programme remain the intellectual property of Pangolily Talent Management.
10.2 The Client may use these materials for personal use only.
10.3 Redistribution, reproduction, or commercial use is prohibited.
10.4 The Client shall not record, broadcast, or reproduce any audio, video, or digital output of any Session without express written permission from the Coach. Any materials shared via Notion or email are granted under a personal, non-exclusive, non-transferable license for the Client’s sole use.
11. Liability
11.1 The Coach is not liable for any decisions the Client makes based on the Programme.
11.2 The Coach is not responsible for the Client’s professional outcomes, including auditions, representation, or bookings.
11.3 The Programme is not a substitute for acting training, therapy, or legal advice.
11.4 Limitation of Liability: To the maximum extent permitted by applicable law, the Coach’s total cumulative liability arising out of or related to this Programme, whether in contract, tort, or otherwise, shall be strictly limited to the total amount paid by the Client for the Programme (£500). The Coach shall not be liable for any indirect, incidental, or consequential losses.
12. Complaints Procedure
12.1 If the Client wishes to raise a concern or complaint, they must do so in writing via email to office@pangolily.co.uk.
12.2 Complaints must be submitted within 14 days of the issue arising.
11.3 The Coach will acknowledge the complaint within 5 working days and provide a full response within 14 working days.
11.4 Complaints will be handled professionally and fairly.
11.5 Submitting a complaint does not pause, extend, or alter the Programme schedule or refund policy.
11.6 Working days are Monday to Friday, excluding UK bank holidays.
13. Governing Law
13.1 These Terms & Conditions are governed by the laws of England and Wales.
13.2 Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Force Majeure
14.1 The Coach shall not be held liable or responsible for any delay or failure to perform services resulting from acts beyond reasonable control, including but not limited to severe illness, technical network outages, or emergency circumstances. In such cases, the Coach will offer to reschedule the affected Session at a mutually convenient time.
